DHS Ends Automatic Extensions of Certain Employment Authorization Documents (EADs)

The Department of Homeland Security (DHS) has issued an interim final rule ending the practice of automatically extending employment authorization documents (EADs) for certain renewal applicants.

Effective October 30, 2025, individuals who file to renew their EADs will no longer receive an automatic extension of employment authorization, except in limited cases provided by law or through a Federal Register notice (such as for Temporary Protected Status (TPS) holders).

According to DHS, the change is intended to increase screening and vetting of applicants before extending employment authorization, allowing U.S. Citizenship and Immigration Services (USCIS) to detect fraud and identify individuals who may pose security concerns.

Current EADs that were automatically extended before October 30, 2025 are not affected by this rule.

Action Required:

  • Employers and foreign nationals should plan for longer EAD renewal processing times.

  • Applicants are strongly advised to file renewal applications up to 180 days before their EAD expires to avoid work authorization gaps.
